Causes

What Are the Most Common Causes of Wrongful Death in Bicycle Accidents?

Bicycle accidents that end in tragedy often occur because of risky choices made by drivers on the road. Here are the most common causes of wrongful deaths:

  • Distracted driving. A driver who is texting keeps full speed while looking away, and a cyclist is what they fail to see.
  • Speeding and reckless driving. Higher speed cuts reaction time and multiplies the force of impact, which turns a survivable crash into a fatal one.
  • Failure to yield and share the road. Drivers pass too close, turn across a bike lane, or fail to yield at an intersection. A driver who opens a car door without looking doors a rider straight into traffic.
  • Drunk or impaired driving. Alcohol was involved in 33 percent of fatal cyclist crashes in 2024, counting the driver, the rider, or both.
  • Dangerous road conditions. A pothole, a missing sign, or a bike lane that ends without warning can put a rider under a car. That makes the city or its contractor liable rather than the driver.

Statistics

Bicycle Wrongful Death US Statistics

In 2024, 1,103 cyclists were killed in crashes with motor vehicles and another 52,887 were injured, according to NHTSA. Urban streets accounted for 81 percent of those deaths. Each one ended a household’s income as well as a life.

That total fell 6 percent from 1,173 in 2023, the first drop since 2019. It still works out to three riders a day, and a third more than the 829 killed in 2015.

Summer carries 31 percent of those deaths and fall 30 percent, but the hour matters more than the season. In every season the deadliest window is 6 to 9 p.m., and 52 percent of cyclist deaths happen in the dark.

Claim

Who Can File a Wrongful Death Claim in a Bicycle Crash?

  • Surviving spouse. No proof of dependency required in most states; covers lost companionship, financial support, household income.
  • Children of the deceased. Biological and legally adopted; some states include stepchildren or grandchildren if dependency is shown.
  • Parents of the victim. Move up the priority list if no spouse or children exist.
  • Financial dependents. Those who can prove reliance on the cyclist’s support.

In most states, a wrongful death lawsuit must be filed by the personal representative of the deceased cyclist’s estate, not directly by the family. If no representative was named in a will, the court appoints one. The representative files the lawsuit, but any damages recovered go to the eligible family members listed above.

Filing deadlines vary by state. Some states give families as little as one year; others allow up to three. Missing the deadline usually means the court dismisses the case regardless of how strong the evidence is. An attorney can confirm the exact statute of limitations that applies to your situation. For a state-by-state breakdown, see our bicycle accident statute of limitations guide.

Liability

Which Parties Can Be Held Accountable for a Fatal Accident?

Liability for a wrongful death in bicycle accidents typically falls on the party whose negligence or actions caused the fatal crash involving a cyclist. This could be a motor vehicle driver, especially if the accident was the result of distracted, impaired, or reckless driving. In some cases, government entities may be held responsible if poor road conditions or inadequate signage contributed to the accident. Likewise, construction companies can be liable if unsafe construction zones or hazards caused the death of a cyclist.

Examples:
  • Motor Vehicle Driver
  • Another Cyclist
  • Government
  • Construction Company

Determining liability depends on the specific circumstances surrounding the accident and the actions of those involved.

Recoverable Damages

What Damages Can Be Recovered in the Wrongful Death Case?

While no legal action can bring back your loved one, understanding what compensation you can seek helps protect your family’s future. Let’s look at what damages you can be entitled to receive:

Medical Bills

If death was not instant, the medical expenses from those last days can be enormous. Ambulance, emergency surgery and ICU time all count. They belong to the survival claim rather than the wrongful death case, so they are paid to the estate, where liens can reach them. A long hospital course often pushes a case past the average bicycle accident settlement.

Lost Wages

An economist projects what the cyclist would have earned across a full career, then reduces that figure to present value. Salary is only the start. Raises, employer health coverage, pension and retirement contributions, and the household services they provided all carry a number.

Pain and Suffering

What your family can recover changes at the state line. California awards lost love, companionship and comfort, but not your grief, sorrow or mental anguish. The estate’s separate claim for the cyclist’s own pre-death suffering ended when SB 447 expired on January 1, 2026. New York pays pecuniary loss only.

Property Damage

You can recover the bicycle, the helmet, the computer or lights on the bars, phone, clothing, and shoes. Get a replacement quote for a custom build before the insurer values it as a used bike.

Funeral Expenses

Funeral and burial expenses are recoverable in full, including the service, the casket or cremation, the headstone and the memorial. Keep every receipt, because the insurer will ask for them.

How it works

What to Expect When Working with a Bicycle Wrongful Death Lawyer

A wrongful death lawyer steps up as your ally when you lose a relative or a friend in a bike crash. They handle the legal matters so you can grieve and support your family. An experienced bicycle accident lawyer is well-versed in these cases.

  • Gather Evidence

Scene photos, traffic and doorbell camera footage, and witness statements all decay fast. Most footage is overwritten within days. A reconstruction expert can rebuild speed and sight lines months later, but only from evidence someone preserved.

  • Deal with Insurance Companies

Insurers move fast after a cyclist dies. The first offer usually arrives before the family knows what the case is worth. Anything a grieving relative says on a recorded call can be used to cut that offer further. Route those calls to your lawyer.

  • Maximize Claim Value

Most fatal cyclist claims run into the driver’s policy limits. The real work is finding what else you can pursue, an employer’s policy, an umbrella policy, or your uninsured motorist benefits.

Benefits

How to Choose a Lawyer

Not every attorney is familiar with the challenges associated with bicycle fatalities. Some law firms mostly deal with motor vehicle accident cases and may not have knowledge regarding cycling rules. So, here are some key factors to consider when selecting your bicycle accident lawyer.

Focused Legal Expertise

Look for a lawyer whose caseload is bicycle cases, not car cases with a bicycle in them.

Knowledge of Local Cycling Laws

Your attorney should know your city’s bike lanes and local ordinances, and how the courts there have handled cyclist deaths before.

Extensive Experience

Trial experience is the question, not settlement totals, so ask how many cyclist wrongful death cases they have actually tried to verdict.

Record of Settlements and Verdicts

Review their specific results in their cases. A reputable bicycle accident attorney will eagerly share concrete examples.
