Who handles your case

Crashes in Arizona. Robert Goldwater and the firm’s team handle the case.

Crashes in other states. When a crash happens in another state, we work with an attorney licensed in that state, who handles the case or handles it jointly with us. Before you sign a fee agreement, we tell you that attorney’s name and law firm, which firm is responsible for which part of the work, and how the fee is divided between the firms.

We do not handle criminal defense, family law, workers’ compensation, or car crashes that did not involve a cyclist.

How a case works

  1. Free case review. You call or send the online form. We ask what happened, where, and what injuries you have.
  2. Investigation. We collect the police report, video, witness statements and crash data, and bring in reconstruction experts when needed.
  3. Documenting your losses. Medical bills, lost income, damage to your bike and gear, and pain and suffering.
  4. Insurance claims. We deal with the adjusters, so you no longer have to take their calls.
  5. Negotiation. We do not accept an offer that ignores your documented losses.
  6. Lawsuit. If the insurer will not pay fairly, we file suit and prepare the case for trial.

Fees and costs

  • No upfront payment and no hourly billing.
  • 33% of the recovery if the case settles before a lawsuit is filed; about 40% if a lawsuit is filed.
  • Case costs, such as filing fees, medical records and expert reports, are listed separately in the fee agreement.
  • If there is no recovery, you owe no attorney fee. The fee agreement explains how case costs are handled in that situation.

How much does it cost?

Nothing upfront. The fee is 33% if the case settles before a lawsuit and about 40% after one is filed. No recovery means no attorney fee.

Can I recover if I was partly at fault?

In most states, yes, with your recovery reduced by your share of fault. A few states bar recovery at any fault, and others bar it at 50% or 51%. Our bicycle laws by state explain the rule where you ride.

How long do I have to file?
